These Terms of Service ("Terms") govern your use of services provided by Artisan Concrete & SurfaceWorks ("we," "us," "our," or the "Company"), including but not limited to concrete installation, decorative overlays, stamped concrete restoration, staining, resurfacing, sport courts, driveways, patios, consultations, quotes, project management, and any related communications (website, phone, email, or text/SMS).

By engaging our services, requesting a quote, signing a contract, or providing contact information (including your mobile phone number), you agree to these Terms. If you do not agree, do not use our services or provide your information.

1. Services We provide concrete and surface works services for residential and commercial clients. Services are subject to availability, site conditions, permits, and a separate service agreement or quote. Estimates are non-binding until a formal agreement is executed.

2. Payments and Billing Payments are due as specified in quotes or contracts. We accept major credit cards, checks, and other methods as agreed. Late payments may incur fees. You authorize us (or our processors) to charge provided payment methods.

3. Customer Responsibilities You agree to provide accurate information, access to the work site, and necessary approvals/permits. You are responsible for site preparation as agreed.

4. Limitations of Liability Services are provided "as is." We are not liable for indirect, consequential, or incidental damages. Our total liability shall not exceed the amount paid for the specific service.

5. Warranties We provide limited warranties on workmanship and materials as detailed in your individual project contract (typically 1–5 years depending on the project type). No other warranties, express or implied, are provided.

6. Termination and Cancellation Either party may terminate in accordance with the project agreement. Deposits may be non-refundable for custom or initiated work.

7. Governing Law These Terms are governed by the laws of the State of Texas. Disputes shall be resolved in the courts located in Harris County, Texas.

8. SMS/Text Messaging Terms & Conditions You may have the opportunity to opt in to receive text messages (SMS/MMS) from Artisan Concrete & SurfaceWorks, sent using an automatic telephone dialing system or artificial/pre-recorded voice technology. These messages may include promotional offers, project updates, appointment reminders, quotes, service alerts, satisfaction surveys, or other communications related to our concrete and surface works services.

Description of SMS Use Cases Messages may include: promotional/marketing content (e.g., special offers, discounts on concrete services, overlays, or restoration), transactional/non-marketing messages (e.g., appointment confirmations, project status updates, payment reminders, service follow-ups), or responses to your inquiries.

Consent Consent to receive automated marketing text messages is not a condition of purchase or engaging our services. By providing your mobile phone number (e.g., during quote requests, consultations, sign-ups, or contracts) and agreeing (via checkbox, verbal confirmation, or other clear action), you expressly consent to receive recurring automated promotional and informational text messages from us at the number provided.

Opt-Out Instructions To stop receiving messages, reply STOP (or UNSUBSCRIBE, CANCEL, END, QUIT) to any message. You will receive a confirmation message. After opting out, you will no longer receive SMS from us (except possibly one final confirmation). Note: Opting out does not affect prior express consent for non-marketing communications if required by law or contract.

Message & Data Rate Disclosure Message frequency varies (e.g., up to 4–10 messages per month, depending on your interactions/projects; promotional messages may be less frequent). Standard message and data rates may apply, as charged by your mobile carrier. We are not responsible for these charges.

Carrier Liability Disclaimer Carriers are not liable for delayed or undelivered messages. Participation is subject to your carrier's terms.

Age Restriction You must be 18 years of age or older to opt in to our SMS program. By providing your number and consenting, you represent that you are 18+.
